need legal help!

My ex's Dad still owes me $500 from a bounced check he wrote me. I live in FL, he lives in MD. Is this too little to sue for? Can I take him to small claims court for such a small amount? Does the difference in states make a difference? Please help guys! I need this $ back ASAP, and this is the only way that fat fuck will pay me. Thanx :bigthumbu
 
You can take someone to court for a penny if you want to. The question is: Is it worth the trouble? You will probably end up paying $500 just to get those $500 back. Not sure how to define jurisdiction but if you go small claims and you win the case, most likely the other party has to pay your money and all other costs involved and you are set. But if they win, you loose your money plus court costs and whateverelse involved. I think that's how it works more or less. Might not be worth the inconvenience. I was going to take someone to small claims last year here in Florida and it was going to cost me $400 just to file. I bought paperwork online for like $3 (Package with instructions and forms). If you don't know what you are doing, you will have to hire an atty and the expense situation scales. Down and dirty, that's pretty much what I know.

I say you are better off by going to MD yourself accompanied by your favorite torque wrench. Maybe that will shake his bank acct. up a little! :D

ya, i know he probably wont anyways. but if i win in small claims court, then i have the court behind me to help me get my $.

either way, i know he probably still wont pay, so a trip to MD with a torque wrench is probably my best bet. anyone going up there soon and wanna do me a favor? :bigthumbu
 
um dont ask us...talk to a lawyer and see if its worth it...who knows you might get your money back and some more...or you might not get it back and have to pay more...either way if you really need to the money talk toa lawyer and see what can be done to get it back, its rightfully yours anyways...


ps. if you want some legal help here.. talk to dudocious i believe he works at a law office maybe he can point you in the right direction or explain to you what you will need to help you out in your best interest.

At the end it is all about what u can prove. If you have proof he has something that belongs to you (i.e. money) and has not returned it, then you should win a case. Still, I think you might end up paying more just to get there plus the inconvenience. I insist on ur favorite torque wrench or MR. 12Gauge as someone else said. take ur pick!

the lawyer will tell you what and how you need to prove it.....and will try and help you to prove it to the judge as best as possible...lawyers are paid to sit there make fun of your life....its their job.

I agree but lawyers themselves are trouble too. Needs to be a trustworthy one. Specially for $500. For that amount it might not be worth it. You might end up paying more then you are owed. Not all but many of them are crooks. Don't get me wrong, I think its fucked up that somebody else ends up with your hard earned belongings even if it is a penny; so I understand someone's desire to fight back for their shitt. But sometimes you loose more than what you intend to recuperate. You know how much a lawyer will charge for a first visit just to give you possible options? And thats all they offer, possibilities. Then you choose one and hope and pray they really help you out. I used to work in a law office, they can be pretty fucked up!
