Racing on Highway Infraction (acceleration)

Driving down the road 5mph above the speed limit. Pulling up to a stop light so Im downshifting into gear and the cop hears my exhaust. He decides to pull me over..>Fu$#%$ this sux...so he comes up to me and says I dont have you on radar but you were speeding, then he comes back and says Im not giving you a ticket for your exhaust but heres a ticket for racing. Now im going to court in 30 days WTF? Any body have advice for me.>I hope I dont get FG54%$#% ed on this one.
The ticket is 316.191 (accerleration) but it seems like Im Fubar if he shows up. Theres no proof, no radar, no video footage. So theres no proof beyond a reasonable doubt..Anyone else fight something like this. I really need ya help on this one guys
 
get a lawyer... thetickethelpcenter.com has fought 2 of my tickets so far dismissed (well one is in the process)
 
um doesnt really need video or shit like that lol.....his word against yours...take it to court...or say bye to ur lisense for a year....ive gotten 2 of these faught one got dismissed...second....no contest ....basically no lisense
 
these kind of tickets are complicated.

They usually require a court appearance with no option to pay a fine. I got myself a lawyer, and fought it. It was ultimately dismissed, after they asked ME to appear in court. Cost me about 800 dollars, and about three months of anxiety.

if this guy has had good experience with them as he says, I second this option. The cop already told ya there is no speed reading on you!

Only 5mph and no official rad reading! What a dick! (the cop of course)

oh whoops. didn't notice you were in J-ville. ticket clinic then i guess. they've got locations everywhere i believe. and they usually guarantee no points and no traffic school so long as you haven't received any other tickets within the last 2 years. :)

I usually end up there too. $65 and no points. Sometimes I end up paying court fees though. But at least, I don't end up with points or having to go to traffic school. Ticket Busters also have worked for me but I don't know if they have offices all the way to JAX. Good luck!

Can they really come down on someone for exhaust? Why, for loudness? I never heard of something like that being enforced down here. Whatever it takes to meet that quota, right! I insist, what a dick!

are you kidding? lol i've gotten a few of those and i know people who have too. they do it all the time. but it's easy to get thrown out. waste of time.

Yeap! believe or not; never heard of it! I have stock exhaust on my present car but used to have a pretty loud one on another s14. I never had such situations. Is this because of noise?
 
yeah most of the time they'll get you for noise. but there's another statute about improper exhaust or some chet.
 
yea im gonna fight it but still kinda confusted. some people say fight it in court and the cop prob wont even show up and it will be dropped etc...on the otherhand though if he does show I might be fubar...its a crappy game of gambling if you ask me
 
my unlce had a cop once that didnt have a radar gun or any of that bullshit... he fought it... you know what they said when he went to court, the cop was trained by eye to tell how fast he was going so he could calculate his speed, stricktly by eye.... talk about boggus... but thats this county for you.. i would try to fight it if i were you. gl mang either way.

It is kind of hard to help you gamble from down here. Usually, it is easier to decide what to do depending on where infractions happened (the myth is some jurisdictions are stricter than others; for example Hialeah PD Vs. State Patrol and shitt like that). It doesnt always mean you are off the hook but sometimes it does help with guesstimating.
 
If you have a clean record, fight it yourself. You only have to show up to the pre-trial and tell the judge your side of the story. Or you can get a lawyer and pay to have him do the same thing. If your record sucks however, a lawyer might be your only option to get out of the ticket.
 
get a lawyer. Your first time to court the only thing you will be doing is pleading guilty, not guilty or no contest, you make your plea then you goto another court hearing
