Florida sued for ticketing motorists that warn others of speed traps

Florida is facing a class-action lawsuit from drivers who have been ticketed for attempting to warn other motorists of hidden speed traps. According to WTSP 10 News, Eric Campbell was recently cited for just that, despite the fact that there is no law against using one's headlights to communicate with other drivers. The officer who ticketed Campbell used Florida State Statute 316.2397, even though the courts ruled that the police were wrongfully applying the law to crack down on vehicle-to-vehicle communication in 2005. Now Campbell wants his $100 ticket refunded and $15,000 in damages.

Since 2005, over 10,429 drivers have been cited for flashing their high beams, and if Campbell wins his case, Florida could be facing over $1 million in ticket refunds. But that's nothing compared to the $156.4 million the state could have to pay out if each driver is awarded $15,000 each. Hit the jump to take a look at news report on the lawsuit.

it sucks these FLA drivers are being cited for flashing the lights... but to call the cops useless is a bit too far.
yea some cops like to abuse power and sometime can be a bit unfair with the citations but very few cops do this.

however I as a fellow driver I feel the pain for the people cited but its easy to say " FUCK YEA!!!, FLORIDA FUCKED WITH THE WRONG GUY, PAY UP BITCH" and so on w/o taking in consideration how $1 mill can affect a state that is not as rich as some people think.

if the state loses the case, I agree with the $100.00 for the fine and court cost being returned to the driver... but I dont see how he could have $15k in damages, along with other drivers... maybe $1000.00 but not $15k.
 
i had a bad experience in lee county. some hick pulled me over and impounded my car, gave me 1k in tickets right iin front of my neighborhood cause i tested my car on a back road (no speeding, drifting, or anything stupid) just cruising to see if it would overheat.


after that and seeing how they pursue ppl non stop in that town makes me bitter. i kno all of them are not like that. im considering going into law enforcement myself. but when i see that this police officer pulled that guy over for warning others it made me have a flashback / rant
