hey guys well, back in december i got in an accident.

i was going to make a left on the intersection on a street, and the light was yellow and it was night and raining. when i took the light i saw the first 2 cars stoped but no car on the last lane. then when i saw a big ass suv and next thing it hit the side of my 240
the cops came and saw that my car was still driveble even dou the side was done and the frame was bent and my rear tire had like -900 camber.

the cop blamed me for taking the light. and not her even dough she saw it and had more than enough time to stop. but decided on taking it even dou she had kids in the car too.

so i got blamed. ( isnt there a no fault law that was effective till january?)

i just payd the ticket., and now im being contacted by a lawyer saying that i owe 2600$$$$$
or that i need to prove that i had damage and such to kinda even out or sum i duno.
neways i olny got like 2 piks of the wrecked shell.

does anyone here know a good lawyer that i can contact to help me, because im, not ready to just pay 2600 bucks....

impossible. same shit happened to my friend. his light turned green, and some red honda ran his red light and totally fucked my friend over, he went to the hospital for a minor concussion while the stupid honda driver told the cop it was all my friends fault and the cop didnt even acknowledge the fact that my friend had a concussion.

so basically your saying the lady ran the yellow light that turned red and fucken hit you, side impact. was your light green? because if it was then it was her fault.

did you talk to your insurance company? if it wasnt your fault you didnt have to pay the ticket and your insurance company should of fought for your case with her insurance company. there are tons of things you can do that can help you get a lawyer, but you have to collect the evidence and present your case to a lawyer to make them want to represent you. such things as talking to the traffic control department to see if they may have the lightings for that date and time of year. you might need any medical stuff or bodywork reciepts or quotes from the crash. just anything you might need to help you out. otherwise you might get a bad lawyer who dont give two shits if you win or lose.

im pretty sure no fault went out october 2007.

i dont know much about lawyers in miami, but i think someone on here's gf works at a law firm. damn i forgot her name. ask meghz she knows. =]

Yeah, man. You can contest that. I'm not sure about now. But there's no law in history that forces you to pay party X if you didn't go to court first. So, unless there was a court day and you just weren't invited, send that letter right up their asses. Florida seal or not. Until the police show up on your door step, tell that lawyer to suck a dick.
Further more, you might be able to sue them for harassment or even fraud. If you can, scan the picture and throw it up. Let's see what it has to say.
And you should definitely contact your insurance company and say that it wasn't your fault and explain the scenario.
Even though, technically, it is. The person turning must yield to people going straight, and even though the light was yellow, she still had the right-of-way. It's a lose-lose situation. If you didn't go, you're blocking the intersection. If you did you're not respecting right-of-way.


P.S. It's Though not "dou" and "dough". Might wanna look into that, bro.
 
I'm pretty sure paying the ticket was an admittance to guilt. This should have been handled by a lawyer from the start. I'd just jump in the phone book and find a traffic lawyer with free consultations. Make 30 appointments if you have to and stop when you talk to one you like. Good luck
 
thanks guys but the problem is that. at the time of the accident i had a fake insurance. you kno the ones that you show and is ok to get registration or pass by a cop. but is not real.
so statefarm went to try contact them but since they dont excist , they went to me.
i talkd to a lawyer back then and he told me to either contact the insurance company to settle. or to igore it and it may go away.
i got like 3 leters from statefarm and now i got one from the state of florida department of highway safety and motor vehicles....
saying that i need to get an insurance company, or that i need to pay 2600 or that i need to show proof of my damage to vehicle and or body.....

now the car got totaled the side was done. i took one pik. and thats all i have. the shell got stripped and junked. so i have no recipts or nothing....
and i had no body injury.....

so i dont know. this is looking ugly =(
and a lawyer will charge me at least 500 to take the case so if i loose then is like 3100$$$$

and yeah both her light and my light were yellow so i did not respect the right of way but i was in the middle of the intersection so i had to go.

i think she was driving careless. wdf.....
im so stressed out.... if i have to pay for this im done for.....
and i have a bad driving record so i cant get real insurance cus it would be 1200 down and 600 a month... and thats cheapo pip..... im not kidding.....
 
wow. you are seriously fucked. im not joking. driving without insurance is really against the law big time. you might have to pay her insurance company and deal with the state of florida. I dont think you can avoid that. honestly, i dont wanna give you hope but i dont think you could win. but i could be wrong. but that is a very slim chance.

You're in a bad spot. If I'm not mistaken, you're wide open for an insurance fraud lawsuit.

Pay the lawyer and make sure he knows his sh*t. At this point, unless he knows a loophole, you're f*cked. But his ass might get you to keep your license, and keep costs to a minimum.

Trust me when I say that $2600 is the least of your worries if you get taken to court.

If this was indeed her fault, then it's somewhat your bad for not chasing down any witnesses that have seen this.

My best advice to you: don't cheap out on a lawyer. Get someone who KNOWS their sh*t.

Your screwed man. I can promise you that thet are in the process of having your license suspended right now. Your best bet is to contact State Farm and try to work out a payment plan. You will NOT win in court. What you said makes no sense either. If both lights were yellow then you ar at fault for not yielding the right of way. Period.

You fucked up by not having insurance and this is what you get. I don't give a shit how much it costs you. If you don't have insurance then don't fucking drive in the streets... Have fun with all that and good luck because you a are going to need it:rolleyes:.

BTW- No fault has to do with bodily injury, not who is at fault for the accident. No fault means that if you are injuried in an acident YOUR PIP (personal injury protection) is primary for reimbursing you for injuries, missed work, etc. It covers up to 80% of the medical bills, 60% of lost wages, up to 10k. If the other person breaches the 10k or if they just want what they had to pay oop for then they will come after you for the injuries or missed wages that they did not recover from PIP. This sound to me like they are just trying to recover the money they spent repairing the other persons car as they (State Farm) found YOU "at fault" for the accident. And since you didn't have an insurance company to fight on your behalf it really doesn't matter even if you weren't at fault for the accident. It's now your word against theirs and I can Gaurntee you they will win. I used to do it for a living and I would FUCK OVER anyone driving uninsured responsible for an accident EVERY TIME. There is no excuse.
