well after a night or working on my 86. it all started at 8 something he starts bitching my bothers car is to loud. Ive lived in the same house for 16 years. he has been here 6 months. yelling followed by me being pinned to the ground by 3 people to keep me from ripping his head off.

the very min i even attempt and succeed to start the car they come out with crow bars and hit my z witch is on my property. and i nicely made him go to sleep the hard way. now im stuck waiting they ant called the cops but not sure where i stand now.
 
if he stepped on ur property when you "made him sleep" you're A ok being that he was uninvted(not to mention if he came with a crowbar thats considered a weapon and your entitled to defend your self)

yea but what are the laws that he threatened to kill my dog. where do i stand on the noise factor it was before 11 and all cars have full exhaust. so i know i wasnt over the sound level.
 
before 11? str8 bro..ur good man jus tell the cops he threatened u and u used self defense to protect urself and ur family
 
if he came over and fucked with your shit over a noisy car then he is at wrong and you can take him to civil court if you have evidence/witness etc. and get w/e damaged paid for... either way you can still get in trouble/harrassment for domestic violence IF the cops woulda showed up. but since it already happened, you cant get in any trouble.
 
If it happens again just yell at the top of your lungs, "Stop, I AM IN FEAR FOR MY LIFE" That way everyone around will know it is SELF DEFENSE, That works even if you are on the offensive ;)
 
Id deff. call the police about him beating your car and file a report. Tell them what happened. The guy came over and started to destroy your property with a crowbar, then he came at you with a crow bar and you put his as out. Thats AGGRIVATED ASSAULT....a FELONY in the great state of Florida.

You car also get an order of protection against him for his actions with the crowbar, so he won't be coming over any more....might even be forced to move?

Id contact the police dept and file a report. If a person comes on your property...with a weapon in hand...you have the right to protect yourself and your property. Should have restrained his ass and called the cops last night dude...then he would have went to jail.

U>ME i would have shot his ass.....dont bring ur drama near me or my car....if im bothering you call the cops but dont come to try and put ur hands on me....i would have definately shot him and waited(not to kill btw).....ppl are brave this day and age man...but gl with the situation file that report
 
if he came on your property with a weapon you can shoot him fuck punching him. If i were you id call the cops and get his ass arrested for trespassing on private property.
 
well there is no sound ordnance anymore any time during day and night i was in the wrong. cops where here today and i was in the wrong even tho he came up to me... so i got charged with violence thx god for my sister being a cop. so i got a slap on the wrist but its just fucked up u cant work on ur own cars in ur yard without having to be told what to do.
 
hold up...so u were in the wrong??? even though he didnt call the cops and insisted on entering your property with a weapon??? I'm confused!?!?!??!?!

next time he even looks ur way, call the cops on the spot, dont wait, keep making reports and that would look bad on him and take pics of wat goes on... if he beats u car... PICS!!! I know as a man that sounds like the pussy way but u wont get in trouble, and u will stay out of Jail!

ok so i normally come into a thread like this, have at least hours of research and reading, but im tried and i have class in about an hour. this is what i can give to you.

1. If you live in a HOA neighborhood, contact your HOA board and file complaints.
read this question and answer here
read this about noise and if they are renters

2. file police reports for trespassing on your property, unruly behavior whatever you deem necessary.
trespassing in laymen's terms
3. file a restraining order on him
this is how you do it --> click here --> article on domestic violence but you can use it in your case.
4. if he caused property damage file a civic lawsuit (claims court for damages)

***if the guy just bought a house next door, then you need to follow the above steps. if he is renting, you need to contact his landlord and try and get him evicted. Since you own the house or your parents do (I'm assuming since you lived there for 16 years) there is a buddy buddy relationship on being neighbors, landlord dont want problems with bad tenants in their homes. (unless the landlord is a douche)

on your self-defense deal:
you can really only use enough self-defense to keep yourself from alot of bodily harm, but you do have a right to protect yourself and your property

im sitting on assault, noise, & to many vehicles in my yard. tbh i was so pissed that i even took the day off my father is getting a lawyer cuz it dosnt make any sense to me. not sure what story the cops heard but apparently they are not to bright. sould be sorted soon cuz there is no way im paying anything. he fucked up mt roof.

thx for the info we are going to do that today. if i can get him removed from here the better it will be.

whats your guys take on this? if someone moves in next to u after u lived there for 15+ years who has a right to complain?

im a junior studying finance and psychology :bigthumbu

a male officer once said to me when i refused to be searched: "tell me in the constitution that I cant search you." I couldnt, so i had to consent to a pat search (i was like 17). I vowed never to be taken advantage like that again and keep the bill of rights in my car at all times. that day my 4th amendment was violated. so i learned really quick how to find information and become resourceful.

at my parents place (where i currently live) we have HOA. they are evil tyrants who only work for people who actually go to board meetings, but all in all, if we dont like a tenant or a renter in the neighborhood that is making problems, trouble, noise, etc... we talk to the HOA which then talks to the owner of the home.

all in all, if they did that stuff to my house id start by taking my own advice and getting a lawyer. good luck.
