summoned to court? anyone know a credit/debt lawyer?

I got a notice that ive been summoned to court for unpaid balance on a credit card. I was wondering, do I need to take this seriously? :ugh:

"if you do not file your response on time, you may lose the case, and your wages, money, and property may thereafter be taken without further warning from the court"

Im sure with the economy the way it is alot of people, maybe even some of you have received similar notices? been through this before? know a good lawyer?
 
you dont have to show up if don't want to but it is bill collectors seeking to dock your paycheck plus late fees and interest and court fees.

I owed some years back around 4k after 4 years they took me to court I didn't go. They docked my paycheck a percentage of what I took home not the gross and at 11% interest.

that was for a credit card btw
 
FML... that sounds like alot, HMMM... DOCKED, as in they took it and you didnt have an option to pay?

so Bankruptcy is looking good right about now.
 
my bro just went to one the ther day. took 10 mins. if you have no stocks, 401k, savings accounts, or high income, they will be like, 'Ok well it would be good if you can pay this off'.

its no big deal, but you do need to go b/c you can be arrested for contempt of court(im sure it says that on yor lil piece o' paper)if you dont.

Bankruptcy will cost you $2500-$3000...

Dont go bankrupt, there is nothing they can do to you, and they legally have to take it off your credit in 7 years. Pay it off and your credit will still suck until it is completely off your credit report in 7 years.

Go bankrupt and pay higher % always forever no no no...dont do it.

your best bet is to go , i work in the orange county court house ... or better said WORKED....
if you dont show up, you can not defend yourself and argue the amount the collector is demanding
dock your pay if you make more than what the minimum requiers
you dont need a lawyer
just go there, a lawyer will cost more than 1500, and that doesnt look good if your claiming you have NO WAY of paying. if you cough up 1500 for a lawyer they think that you have NO INTENTION of paying, bringing all the interest rates on you
like a month ago mabe more i was in one hearing about american express and a 20g debt, the guy had lost his job ,house and was working in a fast food restaurant as an assistant manager, the judge took off the interest, and some late fees, and ordered the guy to pay 35 bucks a month minimum.... so just go and hopefully you can convince the judge to reduce the charge amount

Sounds like you let it go way longer than you should have.

If you EVER get contacted by a collection agency, immediately send them a letter demanding that they verify the debt and to stop all contact and reporting on your credit until they do. It will save you A LOT of trouble and buy you tons of time to come up with the money to pay your debt.

Also, when you mail it, make sure you use certified with a return receipt so they cannot deny that they received your request for debt verification/validation.
 
sounds like they are trying to cock dock you man, just pay your stuff man, and listen to the above advice
